These Terms and Conditions apply to all services and SMS messages sent and received under ThriveSystems, a trading name of WEBTHRIVE LIMITED (Company Number 16226577). Your use of this service constitutes acceptance of these terms.
1. About ThriveSystems
ThriveSystems is a brand operated by WEBTHRIVE LIMITED, a company registered in England and Wales under Company Number 16226577. All contracts, billing, and legal obligations are entered into with WEBTHRIVE LIMITED, trading as ThriveSystems.
2. SMS Disclosure
By opting in to our SMS services, you agree to receive text messages relating to service notifications, marketing offers, account authentication including 2FA, and other service-related communications. Message frequency may vary. Standard message and data rates apply according to your mobile carrier. You may opt out at any time by replying STOP to any message. For assistance, reply HELP. For details on how your data is handled, please refer to our Privacy Policy.
3. Messaging Consent
You must explicitly consent to receive messages from ThriveSystems. Consent may be provided through website forms, digital or paper forms, or verbal consent via customer support. Consent records may be retained for compliance purposes.
4. Message Types and Frequency
Messages may include alerts, reminders, promotional communications, system updates, and service notifications. Message frequency depends on your activity and preferences.
5. Data Rates and Charges
Standard message and data rates may apply to any SMS or MMS messages sent or received. These charges are determined by your mobile carrier.
6. Opt-Out Instructions
You may unsubscribe from SMS communications at any time by replying STOP to any message we send.
7. Message Delivery
We do not guarantee uninterrupted or error-free message delivery. Delays or failures may occur due to factors outside our control, including carrier issues, network availability, or device compatibility.
8. User Obligations
You agree to use our services in compliance with all applicable laws and regulations. You must not use our platform to send content that is unlawful, misleading, abusive, or intended to harass or harm others.
9. Legal and Regulatory Compliance
All messaging and platform usage must comply with applicable privacy, telecommunications, and commercial communication laws, including carrier and A2P messaging requirements.
10. Subscription Plans and Billing
ThriveSystems provides subscription-based services which may include website creation and hosting, CRM and automation platform access, business phone numbers for SMS and voice, marketing tools, and optional advertising management services. Pricing and billing terms are presented at checkout or within your service agreement. Subscriptions may be month-to-month or prepaid where applicable.
11. Advance Payment and Auto-Renewal
All subscription fees are billed in advance and automatically renew unless cancelled. Payments are processed securely via Stripe or an equivalent payment provider.
12. Usage-Based Charges
Usage-based charges may apply in addition to subscription fees, including charges for phone numbers, SMS and MMS messaging, voice calls, and number intelligence services. Exact rates are available within the platform or supporting documentation.
13. Digital Wallet and Auto Top-Ups
Clients maintain a digital wallet balance to cover usage-based charges. When the balance falls below a defined threshold, automatic top-ups may occur based on selected preferences.
14. No Refund Policy
All payments made to WEBTHRIVE LIMITED are final and non-refundable, including subscription fees and usage-based charges. Services are custom-built and initiated immediately upon purchase.
15. Chargebacks
You agree not to initiate chargebacks or payment disputes for services rendered. Chargebacks constitute a breach of these Terms. Evidence of service delivery and platform usage may be submitted in response to disputes.
16. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle. No refunds are provided for unused time.
17. Delivery of Services
Services are considered delivered once the website has been completed and platform access and automation setup have been finalised. Onboarding assistance may be provided but is not required for fulfillment.
18. Free Trials and Promotions
Free trials or promotional offers may be provided at our discretion. Limited setup may occur during trials. Full services begin once billing starts. Discounts do not modify these Terms.
19. Payment Failures and Suspension
If a payment fails, collection may be attempted multiple times. Accounts may be suspended if payment remains outstanding more than 48 hours after the first failed attempt.
20. Agreement and Acceptance
By purchasing services or accepting these Terms at checkout, you confirm that you have read and understood these Terms, accept the No Refund Policy, and waive the right to initiate chargebacks for services rendered.
21. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on our website or communicated directly where reasonably possible.
